The PDPO defines personal data as “data relating to an identifiable individual that is either (a) in an identifiable form, or (b) is capable of being made so by means of further processing” (DPP 1(1)). The data importer must also agree to submit to the jurisdiction of, and cooperate with, the data exporter’s competent supervisory authority for any proceedings aimed at enforcing compliance with the standard contractual clauses. These provisions are designed to give enforceable extra-territorial effect to the terms of the clauses.
